1. Acceptance
By creating an account or using Kinous, you agree to these Terms of Service. If you represent a business entity, you confirm you have authority to accept these terms on its behalf.
2. The Service
Kinous provides a cloud-based appointment management platform for service businesses. Features include:
- Online booking for end customers
- Appointment, team, and service management for businesses
- Automated notifications via email and WhatsApp
- Reporting and analytics
- Customer appointment management portal
We reserve the right to modify or discontinue features with reasonable prior notice.
3. Accounts
- Business accounts require a minimum age of 18 years
- You must provide accurate and complete information at registration
- You are responsible for keeping your credentials confidential
- Report unauthorized access immediately to hello@kinous.io
4. Acceptable Use
You may not:
- Use the platform for any unlawful or fraudulent purpose
- Attempt to access other users' accounts or data without authorization
- Reverse-engineer, decompile, or copy any part of the platform
- Send spam through notification features
- Intentionally overload the infrastructure
- Resell or sublicense access without prior written consent
5. Plans, Payments and Cancellation
5.1 Plans
Kinous offers free plans with limited features and paid plans with full access. Details are available on the pricing page.
5.2 Payments
- Payments are processed securely by PCI-DSS certified third-party providers
- Card data is never stored on our servers
- Subscriptions renew automatically at the start of each billing period
5.3 Cancellation and Refunds
- You may cancel at any time; access continues until the end of the paid period
- No pro-rated refunds for early cancellation, unless required by law

6. Data and Privacy
Processing of personal data is governed by our Privacy Policy. Your customers' data belongs to you — we use it exclusively to provide the contracted service.
7. Intellectual Property
- Kinous and all its components are owned by Kinous
- You retain all rights to data you input into the platform
- You grant Kinous a limited, non-exclusive, revocable license to process that data as necessary to provide the service
8. Availability
We target 99.5% monthly uptime. Scheduled maintenance will be communicated at least 24 hours in advance.
9. Limitation of Liability
To the maximum extent permitted by law:
- Kinous is not liable for lost profits, data loss due to misuse, or indirect/consequential damages
- Our total liability is limited to amounts paid in the preceding 3 months
These limitations do not apply in cases of willful misconduct or gross negligence.
10. Termination
Either party may terminate at any time. Kinous may suspend or terminate accounts for material violations of these Terms. Upon termination, you have 30 days to export your data before deletion.
11. Changes
We may modify these Terms. For material changes, we will provide at least 30 days' notice via email. Continued use after that date constitutes acceptance.
12. Governing Law
These Terms are governed by the laws of Germany. Disputes shall be resolved in the courts of Berlin, Germany.
